1. Introduction

These Terms of Use (“Terms”) govern your use of the Yummy mobile application and the website at yummyapp.co.za (together, the “Platform”) provided by the operator of Yummy (“Yummy”, “we”, “us”, “our”).

By creating an account, signing in, or using the Platform, you agree to these Terms, the Privacy Policy, and the Chat Room Policy. If you do not agree, do not use Yummy.

We may change these Terms by publishing an updated version on this website. Where a change is material we will take reasonable steps to bring it to your attention. Continued use after publication is acceptance of the updated Terms, to the extent Applicable Law allows. If you do not agree, stop using the Platform.

2. Definitions

  • Applicable Law means South African law, including the Consumer Protection Act, 68 of 2008 (“CPA”), POPIA, the Electronic Communications and Transactions Act, 25 of 2002 (“ECTA”), and PAIA where relevant.
  • Content means text, photos, ratings, comments, chat messages, reports, and any other material you submit.
  • Platform means the Yummy Android app and this website.
  • Service means the social food-review features we make available: accounts, city-scoped Home and Discover, posting Yums, following other Users, bookmarks, comments, public city chat, and related support.
  • User / you means anyone who visits the website or uses the app.
  • Yum means a meal review (photo, place, ratings, and short text) posted on the Platform.

3. About the Service

Yummy is a social app. Users share Yums in selected South African cities, follow other cooks, and talk in public city chat rooms.

Yummy is not a marketplace. We do not sell food, take payments, hold money in escrow, arrange delivery, or mediate sales between Users. Vendor names and addresses are text only. There are no maps, GPS, or private direct messages.

Cities may be hidden until there is enough content. Features may change, pause, or be withdrawn without compensation.

Risks of a public social app include other Users’ opinions being wrong or unkind, content you post being seen by anyone signed in, and possible downtime or lost posts. You use the Service knowing those risks.

4. Consumer protection

As required by section 49 of the CPA, your attention is drawn to clauses that:

  • limit the risk or liability of Yummy or another person;
  • constitute an assumption of risk or liability by you;
  • oblige you to indemnify us or another person; or
  • are an acknowledgement of fact by you.

Those clauses include, in particular, sections 9, 10, 14, 15 and 16. If you do not understand any provision, email support@yummyapp.co.za before you accept these Terms. Nothing here is intended to take away a right or obligation that the CPA gives you or us.

5. Access and use

We grant you a limited, personal, non-exclusive, non-transferable licence to use the Platform for its intended social purpose, provided you keep our notices intact and do not copy, scrape, mine, frame, mirror, or commercially republish the Platform without written permission.

We may change, suspend, or discontinue any part of the Platform (including a city or chat room) without notice and without liability or compensation.

We may restrict access for maintenance, security, or new functionality. We try to keep disruption short.

You may not use the Service to process another person’s Personal Information unless you have a lawful basis to do so. You may not hack, scrape, overload, circumvent security, or use the Service for any unlawful purpose.

If you breach these Terms we may, without prior notice and without limiting other rights: suspend or limit your account, terminate these Terms, delete or hide Content, and report conduct to the authorities.

6. Contractual capacity

You must be at least 13 years old, or older if the law where you live requires it. If you are under 18, you may use Yummy only with the consent and supervision of a parent or legal guardian who agrees to these Terms and is responsible for your use.

The Service is not directed at children under 18. See the Privacy Policy.

If you use Yummy for an organisation, you warrant that you have authority to bind it, and it is responsible for your use.

You may not use the Service if we have previously suspended or removed you.

7. Accounts and security

Core features require an account (email and password, or Google Sign-In). Usernames are unique and permanent after signup. Provide accurate information and keep it current.

Keep your login details secret. You are responsible for activity on your account. Tell us at support@yummyapp.co.za if you think someone else has used it.

These are material breaches: impersonating another person; posting Content that violates others’ intellectual property or privacy; using the Service to harm others; collecting other Users’ Personal Information without a lawful basis.

We take reasonable technical and organisational steps to protect account data, as described in the Privacy Policy. We are not responsible for malware or weak security on your own device.

You may delete your account in Settings. Deletion disables the login immediately. Content you already published may remain where needed for security, law, or moderation. Details are in the Privacy Policy and on the Support page.

8. User content

You keep ownership of Content you post. You grant Yummy a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and moderate that Content on the Platform so the Service can run. The licence lasts as long as the Content remains on our systems.

You warrant that you have the right to post the Content (including photos of plates and places), that it is not unlawful, and that it does not infringe anyone else’s rights.

Yums, comments, profiles, follow relationships, and city chat are public to signed-in Users. There are no private DMs. We may remove or hide Content that breaks these Terms or the Chat Room Policy, or that we reasonably believe is unlawful or harmful. We are not obliged to monitor every post, but we may.

9. Prohibited conduct

You may not:

  • post illegal, hateful, harassing, sexual involving minors, or violent Content;
  • spam, scam, impersonate a restaurant or another cook, or advertise unlawfully;
  • share other people’s phone numbers, home addresses, or identity numbers;
  • use chat as a private or off-platform marketplace for illegal goods;
  • interfere with the Service, scrape it, or reverse engineer it except as Allowed by law;
  • create multiple accounts to evade a ban.

Chat rules are in the Chat Room Policy, which forms part of these Terms.

10. Reviews and food safety

Yums are opinions, not professional, medical, allergen, or safety advice. A rating or review does not mean a venue is safe, licensed, or accurately described. Always use your own judgement about food, allergens, and venues.

Place names and addresses are User- or admin-supplied text. We do not verify every vendor and we do not provide maps or directions.

11. Electronic communications

You agree that we may communicate with you electronically (in-app notices, push notifications if you allow them, and email to the address on your account or to support@yummyapp.co.za). Those communications satisfy any legal requirement that a communication be in writing, to the extent ECTA allows.

12. Intellectual property

The Yummy name, logo, design system, software, and this website are our property or used under licence. You may not use them except as needed to use the Service.

If you believe Content infringes your copyright, email support@yummyapp.co.za with enough detail for us to find the post and contact you.

13. Privacy

We Process Personal Information as set out in the Privacy Policy, which is incorporated into these Terms. That Policy explains operators (including Google Firebase), public Content, deletion, and your POPIA rights.

14. Indemnity

To the extent permitted by the CPA and other Applicable Law, you indemnify Yummy and our operators against claims, losses, and reasonable costs arising from: your Content; your breach of these Terms; your misuse of the Service; or your infringement of another person’s rights — except to the extent caused by our gross negligence or wilful misconduct, or where the CPA does not allow this indemnity.

15. Liability

The Platform is provided as available. We do not warrant uninterrupted access, error-free software, or that other Users’ Content is true.

To the extent permitted by the CPA and other Applicable Law, we are not liable for: other Users’ opinions or conduct; decisions you make from a Yum; lost posts, photos, or chat; downtime; or indirect or consequential loss. Nothing in these Terms excludes liability that cannot be excluded (including for gross negligence, or for death or personal injury caused by our negligence, where the law so provides).

If we are liable despite the above, our aggregate liability to you for all claims arising from the Service is limited to R1 000, unless a higher amount is required by the CPA.

16. Assumption of risk

You acknowledge that posting photos and using public chat has privacy and reputational risk; that other Users may post inaccurate or offensive Content; and that visiting a restaurant because of a Yum is your decision. You assume those risks, subject to rights you cannot waive.

17. Complaints

Email support@yummyapp.co.za. We will try to resolve the matter in a reasonable time. Report in-app Content using the report control where available.

18. Dispute resolution

If a dispute between you and us is not resolved through support, either party may pursue mediation or the courts of South Africa. Nothing here limits a right you have under the CPA to approach a consumer tribunal, ombud, or the ordinary courts.

Disputes between Users (for example about a review) are not disputes we adjudicate as a court. We may remove Content or suspend accounts under these Terms; we do not award damages between Users.

19. Governing law

These Terms are governed by the law of the Republic of South Africa. Subject to section 18, the South African courts have jurisdiction.

20. Notices

We may give notice by posting on this website or by email to the address on your account. You may give notice to us at support@yummyapp.co.za.

21. Changes

We may update these Terms as the Service or the law changes. The date at the top will change. The current version is always on this page.
